Privacy policy


Primarius Produkció Limited Liability Company (hereinafter: Service Provider) provides an insight into the work of Zoltán Mága on the www.magazoltan.com website and also operates a webstore. In doing so, the Service Provider will manage the data of those registering at the website (Users).

The Service Provider hereby informs users wishing to register on the website and those who have already registered of the data it manages and the principles and practice applied in data management; organisational and technical measures to ensure the protection of personal data; and the ways and options for those concerned to exercise their rights.

 

The Service Provider will handle personal data registered here confidentially in compliance with data protection legislation and international recommendations, and in accordance with this Declaration.

 

Definitions

 

Act LXIII of 1992 provides for the protection of personal data and the disclosure of information of public interest (hereinafter: Data Protection Act, DPA).

 

Pursuant to the Act:

 

“Data management” shall mean any operation or set of operations that is performed upon data, whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, deletion or destruction, and blocking them from further use. Photographing, sound and video recording, and the recording of physical attributes for identification purposes (such as fingerprints and palm prints, DNA samples and retinal images.

 

“Controller” shall mean a natural or legal person or unincorporated organization that determines the purpose of the processing of data, makes decisions regarding data management (including the means) and implements such decisions itself or engages a processor to implement them.

 

“Personal data” shall mean any information relating to an identified or identifiable natural person (hereinafter referred to as ‘data subject’) and any reference drawn, whether directly or indirectly, from such information. In the course of data processing, such information shall be treated as personal data as long as the data subject remains identifiable through it. An identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to his physical, physiological, mental, economic, cultural or social identity.

 

“Data processing” shall mean the technical operations involved in data management, irrespective of the method and instruments employed for such operations and the venue where it takes place.

 

“Disclosure by transmission” shall mean making data available to a specific third party.

 

“Deletion of data” shall mean the destruction or elimination of data sufficient to make them irretrievable.

 

“The data subject’s consent” shall mean any freely given specific and informed indication of his wishes by which the data subject signifies his agreement to personal data relating to him being processed without limitation or with regard to specific operations.

Controller’s registration ID code: Since data management concerns users in a customer relationship with the Controller, it does not have to be notified to the register, pursuant to Section 30(a) of the Act LXIII of 1992 on the Protection of Personal Data and the Disclosure of Information of Public Interest.

 

Data management

 

Data management, including the recording of identification, delivery and billing data of Users will take place exclusively for operating the services available on the website and to the extent necessary for keeping contact and providing information.

 

Legal grounds of data management

 

Pursuant to Section 3(1)(a) of the DPA, personal data may be processed if the data subject has given his consent, or pursuant to Act CVIII of 2001 on Electronic Commerce and on Information Society Services (hereinafter: Electronic Commerce Act, ECA). The consent is given by using the website (and the service) and by registration.

 

Data managed

 

The Controller manages data made available during registration and making purchases on the website. In registration, the User must give the following personal data: first and last name; postal address, phone number; e-mail address; and user name. In addition, the User may provide further, non-mandatory data.

 

Purpose of data management

 

The purpose of managing mandatory personal data provided during registration is to identify website visitors for their access to the services available at the website; to allow the conclusion of contracts with users and the delivery of products; the documentation of service delivery and suitability of delivery; and invoicing. Data management will take place exclusively for the above purposes; in the manner laid down in legislation; to the extent necessary for the achievement of those purposes; and exclusively with the use of those personal data that are indispensable and suitable for the achievement of the above purposes.

 

Duration of data management

 

Management of mandatory data provided during registration begins with their registration and lasts until their deletion. In the case of non-mandatory data, data management begins with the provision of data until the deletion of the specific data. Invoicing data will be managed in compliance with the provisions of relevant laws and tax regulations, in particular Act XCII of 2003 on the Rules of Taxation. Deletion of the registration may take place in the case and manner laid down in the Business Policy.

 

Disclosure by transmission; Data processing

 

Disclosure of personal data by transmission can happen exclusively in cases defined by law and with the User’s consent. For the operation of the underlying information technology system; fulfilment of orders; and settlement, the Service Provider will be entitled to hire data processors (e.g. systems operator; delivery company; accountant). For the operation of the underlying information system, the Service Provider will use processors who will be responsible for the technical operation of the server.

 

Data security

 

The Controller will make every effort necessary to ensure the security of the Users’ personal data both in network communication and in the storage of data. The Controller will store data with 24-hour security protection in the territory of Hungary, on a dedicated server installed at the location of the data processors assigned to operate the system.

 

User rights and options to enforce rights

 

The website User will have the right to solicit information about personal data referring to him/her managed by the Controller and to modify or delete his/her data on the administration interface accessible via the website. At the user’s request, the Controller will give information about the purpose, legal basis and duration of data management and about the recipients that receive or have received those data as well as the purpose for which they receive or have received them. The Controller will give the requested information in writing within 30 day of the submission of the request. The user concerned may exercise his/her rights at the given contact addresses, in particular the magazoltan@magazoltan.hu e-mail address. The User may turn to the Service Provider’s employee with any questions or comments about data management at the specified address. The User may at any time request the modification or deletion of incorrectly recorded data. The Controller will delete the data within 3 days of the receipt of the request, in which case they will not be restorable later.  The deletion does not apply to the management of data required by law (e.g. accounting regulations); such data will be stored by the Service Provider until the necessary time.

 

The User may enforce his/her rights before the court pursuant to the DPA and the Civil Code (Act IV of 1959) and can also seek help from the Data Protection Ombudsman (1051 Budapest, Nádor u. 22; Mailing address:1387 Budapest Pf. 40; fur further information please refer to: http://abiweb.obh.hu/abi/).

 

If in registration the User provided the data of a third party or has caused any damage in using the website, the Service Provider will have the right to enforce claims for damages against the User. In such a case, the Service Provider will give all help possible to the proceeding authorities to identify the person who has committed the violation of rights.

 

Use of e-mail addresses

 

The Service Provider will devote special attention to the lawful use of e-mail addresses managed by it; therefore, it will only use them in the manner defined below for sending (information or advertisement) e-mails. The management of e-mail addresses will primarily serve the purpose of User identification and maintenance of contact in fulfilling orders, which is the primary purpose of sending e-mails. In certain cases, the Service Provider will send information referring to changes in the services provided by the Service Provider or to other similar services of the Service Provider electronically (by e-mail) to those concerned. Newsletters operated by the Service Provider may contain advertisements. The Service Provider will only send newsletters in the case of the User’s subscription and prior explicit voluntary consent, which consent is given by adding his/her name and address to the relevant interface during registration. The User can subscribe to newsletters on the administration interface during registration. The User can unsubscribe from the newsletters free of charge and without cause at any time on the administration interface of the Service or in the manner indicated in the newsletter.

 

Option to modify the privacy policy

 

The Controller reserves the right to unilaterally modify this Privacy Policy upon notification of the Users. Upon entry into force of the modification, the User will accept the effective modified Privacy Policy by way of his/her indicative behaviour.
